Spain has introduced amendments to its legislation that would impose penalties of up to two years in prison for parents who refuse “gender-affirming therapies” for their children.

In Scotland, similar proposals that included a seven-year prison sentence for parents who discourage their children from undergoing gender reassignment have been shelved.  Instead, the Scottish government has agreed to defer to the UK government. However, the Scottish National Party (SNP) has threatened that if it finds the UK bill insufficient, it will introduce its own bill in the next Scottish Parliament.

Spain has introduced a controversial amendment to its Penal Code, which proposes up to two years of imprisonment for parents, doctors, psychologists or educators who resist so-called “affirmative therapies” for minors who wish to undergo “gender transitions.”

The amendment, approved by the Spanish Congress of Deputies, has drawn significant criticism from conservative sectors and medical professionals, who argue that it criminalises common-sense parenting and undermines parental authority.

The law extends sanctions to parents or legal guardians who “promote, consent to, or facilitate” any form of conversion therapy, even if they intend to protect the minor and avoid irreversible medical transition without proper psychological support.

This measure has placed Spain among the countries with the most radical gender legislation, distancing itself from European models like Sweden or the UK, which have begun to slow down minors’ access to harmful “transgender” medical treatments.

When it comes to “transgender” issues, the Scottish government is an outlier in the UK and continuously attempts to push the insidious agenda forward wherever possible.

In January 2024, the Scottish government proposed a law that would make it illegal to “change or suppress” another person’s gender identity. The law aimed to ban “conversion therapy” and pointed to a 2017 survey, which stated that conversion practices “often happen in religious, community and family settings.”  Under this proposal, parents who refuse to allow their children to change gender could have faced up to seven years in jail.

According to the BBC, the Scottish government wanted to “lead the way” on the ban after the UK government omitted it from the King’s Speech in November 2024, five years after first promising it.

The Scottish government stated that the law would protect people from the harm of conversion practices and contribute to the broader protection of human rights and respect for the dignity of LGBTQI+ people.

The reality is, the proposals would have had a devastating impact on freedom of speech, privacy and family life in Scotland.  It would have criminalised loving parents who refused to sign up to the gender ideology, potentially leading to imprisonment for up to seven years.  It also included provisions for “civil protection orders,” which would have granted courts sweeping powers to curtail people’s free speech.

In September 2024, the Scottish government, fearing a judicial review, dropped its controversial plans to ban conversion practices in favour of “complementary approaches across the UK.” The Guardian reported last month that the Scottish government has dropped plans to outlaw misogyny and conversion practices before the next Holyrood election, arguing they are too legally complex to deliver in time.  Instead, it would defer to the UK government and work on agreeing Westminster-led legislation that would include Scottish measures. 

Scottish National Party (“SNP”) Equalities Minister Kaukab Stewart threatened that “if the UK government’s bill does not meet our priorities or does not go far enough, we intend to publish our own bill in the first year of the next parliamentary session.”

In 2023, plans by then First Minister Nicola Sturgeon to allow children as young as 16 to change gender were also blocked by the UK Government.


But regardless of what agreements it makes with the UK government or what current laws state, the Scottish government appears to be attempting to push forward with its nefarious gender ideology in whatever way it can. 

In April 2025, the UK Supreme Court made a landmark ruling that the legal definition of a woman in the Equality Act 2010 refers to biological women and does not include “transgender women.”  But the Scottish government was dragging its heels in implementing the ruling.

Consequently, the Scottish government was facing legal action from Sex Matters, a UK-wide gender-critical campaign group, if it failed to implement the UK Supreme Court’s ruling on biological sex within 14 days. That was on 18 June.  On 27 June, it was reported that the Scottish government had updated its guidance on the gender balance of public boards, which was the guidance that sparked the legal challenge on the definition of a woman that ultimately led to the UK Supreme Court’s ruling in April.
